Unlike a civilian divorce, a military divorce may be filed in any state where either spouse is domiciled, is a legal resident, or where the service member is currently stationed. That flexibility matters because each state applies its own property division rules once USFSPA grants the court jurisdiction over military retirement. For Florida courts to divide military retirement pay, the service member must be domiciled in Florida, be a Florida resident for reasons other than military assignment, or consent to the court’s jurisdiction. Where the case is filed can affect how retirement benefits are ultimately allocated, so this isn’t a decision to make without counsel.

Dividing Military Retirement Pay

Military retired pay earned during the marriage is treated as a marital asset subject to equitable distribution under Florida law. USFSPA authorizes Florida courts to divide that pay, but the mechanics differ significantly from splitting a civilian retirement account.

Florida courts use a marital fraction to identify the portion of retirement earned during the marriage. Dividing that share requires a Military Pension Division Order (sometimes called a Qualified Military Order), which differs from the Qualified Domestic Relations Order used for civilian pensions. The language in that order must meet Defense Finance and Accounting Service (DFAS) requirements precisely; imprecise drafting can delay payments to the former spouse.

The 10/10 rule governs how payment is delivered. If the marriage overlapped with at least 10 years of the service member’s creditable military service, DFAS pays the former spouse directly. If that threshold isn’t met, the service member pays directly. The Survivor Benefit Plan (SBP) is a separate consideration: it must be requested in the divorce decree to help protect the former spouse’s income if the service member dies after retirement. VA disability compensation isn’t divisible in divorce under federal law, though a court may account for financial offsets when a retiree waives retired pay to receive disability benefits.

TRICARE & Base Benefit Eligibility After Divorce

Whether a former military spouse retains TRICARE and base privileges after divorce depends on specific time thresholds. Understanding which threshold applies to your situation should be part of your divorce planning, not an afterthought.

The 20/20/20 rule: A former spouse married at least 20 years with 20 years of overlapping creditable military service retains TRICARE, commissary access, and base exchange privileges indefinitely, provided they don’t remarry and aren’t covered by an employer-sponsored health plan.

The 20/20/15 rule: A former spouse with 20 years of marriage and military service but only 15 years of overlap receives one year of TRICARE coverage following the divorce.

Below either threshold: Former spouses who don’t meet either threshold lose TRICARE eligibility when the divorce is finalized and must secure private coverage.

Child Support Guidelines for Military Families

Child support in a military divorce is calculated under Florida’s standard guidelines, and military members carry the same support obligations as any other parent. What differs is the income calculation: military compensation components such as Basic Allowance for Housing (BAH) may be considered as income when determining the support figure. The SCRA can pause or delay certain civil proceedings during active-duty deployment, but it doesn’t eliminate the underlying support obligation. These details need to be addressed clearly in the divorce decree to avoid disputes later.

Time-Sharing & Parenting Plans During Deployment

Florida courts focus on the best interest of the child in all time-sharing decisions, and Florida law explicitly prohibits courts from using a parent’s military service against them in custody determinations. That protection matters, but it doesn’t eliminate the logistical challenges deployment creates.

A detailed parenting plan that anticipates deployment schedules, PCS moves, and extended absences is essential for military families. Courts may approve alternative arrangements such as virtual visitation or delegated visitation to a family member during deployment. The Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) states that Florida custody orders are recognized and enforced even if a parent later relocates under military orders, providing continuity across state lines.
